バランスのとれた中道派として評価されていたサンドラ・オコナー判事（７５）の引退表明を受けて、ブッシュ大統領に指名されたロバーツ判事は、１９７９年にハーバード・ロー・スクールを卒業後は、ウィリアム・レンクイスト最高裁判事（現長官）の補助員として調査官を務めた。レーガン政権下では、司法長官の特別補佐官やホワイトハウスの法務顧問の助手などを務めた。
現大統領の父ブッシュ氏の政権下で訟務次官を務め、最高裁で争われる行政関係の裁判で、政府の弁護士となった。この間、中絶権をめぐり米国で激しい議論の焦点となっている「ロー対ウェード訴訟」に対する１９７３年最高裁判決に反対する主張を展開。ロバーツ氏は後にこれは、当時の政府見解を代弁したのであって、自分個人の考えではないと主張している。
投開票結果をめぐりもめた２０００年大統領選の際には、ブッシュ・チェイニー陣営を支えた法務チームの１人だった。

ロバーツ判事はブッシュ大統領を支持する保守派。先週、キューバのグアンタナモの米軍捕虜収容所に拘束されているアルカイダのメンバーに関して、ブッシュ政権が求める米軍特別法廷での審理を認める判決を下した連邦高裁判事の１人。
レンキスト現最高裁長官の助手のほか、司法省訟務局次長（１９８９─９３年）などを務め、２００３年５月にブッシュ大統領が高裁判事に指名した。

ブッシュ大統領がロバーツ氏に白羽の矢を立てたのは、側近中の側近であるカール・ローブ次席補佐官の中央情報局（ＣＩＡ）工作員名漏えい疑惑への関与で、政治的に守勢に立たされており、民主党とこれ以上の衝突を避けたかったためとの見方が強い。

So when he is examined by the Senate Judiciary Committee, it is likely he will be pressed hard for his personal views on divisive areas like abortion, gay rights and medical research.
As news of his nomination broke, rights groups alleged he was hostile to women's reproductive freedom, citing a brief he co-wrote in 1990 on the Roe V Wade case that enshrined a woman's right to choose.
"The court's conclusion in Roe that there is a fundamental right to an abortion... finds no support in the text, structure or history of the Constitution," it stated.
The brief was not a personal opinion, but was written while Mr Roberts was working for George Bush senior.

The choice of Mr Roberts took the political world in Washington by surprise, as most of the speculation leading up to the nomination had suggested the president would choose a woman to replace the outgoing justice, Sandra Day O'Connor, or a member of a minority.

A prominent liberal advocacy group -- NARAL Pro-Choice America -- opposed Roberts' second nomination to the appeals court, saying he has worked to overturn the 1973 Roe v. Wade decision that struck down state laws outlawing abortion.
Arguing a case for the first Bush administration in 1990 when he was deputy solicitor general, Roberts said Roe v. Wade "was wrongly decided and should be overruled."
In his 2003 confirmation hearing, however, he told senators he was acting as an advocate for his client, rather than presenting his own positions.
He told senators Roe was "the settled law of the land" and said "there's nothing in my personal views that would prevent me from fully and faithfully applying that precedent."
Roberts, a native of Buffalo, New York, who now lives in Maryland, is married and has two children. He is a Roman Catholic.
